MessageMuse Terms of Ecommerce and Credit Card Payment

MessageMuse, Inc. and/or its affiliates operate a business providing the services of app development and web presence development. A more complete description of the services provided by MessageMuse can be found on the MessageMuse website located at messagemuse.com. Message Muse Inc. uses Stripe to process payments for services provided by Message Muse Inc.  

These Terms of Ecommerce and Credit Card Payment apply to the content and functionality of using Stripe to process payment for Message Muse Inc. services. When a client engages Message Muse, Inc. for services the client and Message Muse Inc. enter a contract called a Contract for Services. Tasks that fall under the scope of the Contract for Service may be outlined in a Service Level Agreement. The Contract for Services along with the Service Level Agreement associated with a particular service are the client’s contract with Message Muse Inc. Scope of work, compensation for services, timelines for work, payment terms, warranties and intellectual property ownership are all contained in each client’s negotiated contract with Message Muse Inc.

In some circumstances clients and Message Muse Inc. may choose to use online payment processing for payment of invoices for services provided by Message Muse Inc. Message Muse Inc. uses the third party payment processing service Stripe to process online payments. Payment processing using Stripe is governed by the Stripe Services Agreement.

Message Muse, Inc. allows Visa, Mastercard, American Express and Discover card payments through Stripe to process payments. Message Muse Inc. complies with the rules, policies and guidelines of these cardholder networks. Unless otherwise specified, all currency amounts on invoices and Message Muse Inc. contracts are in USD.

1. Information that you provide to us

You may give us information about yourself when you visit MessageMuse.com. The MessageMuse.com Privacy Policy explains our practices with respect to that information.

2. Information You Provide through Payment Processing

Clients who pay invoices using Stripe Payment Processing provide information to Stripe and other third parties associated with the transaction payment method selected by the Client. Message Muse Inc. obtains information that an invoice has been paid by a client, the invoice number, a Stripe transaction reference number, the amount paid and date on which the invoice was paid. Message Muse Inc. does not collect or retain any further information related to the transaction.

Message Muse Inc. will share information collected by Message Muse Inc. with the Client upon reasonable request of the Client.

Information collected by Message Muse Inc. related to transactions is not distributed to any third parties except as is necessary for processing payments, resolving payment disputes, responding to a subpoena, a legitimate formal written request from law enforcement or a Court Order requiring disclosure of information. In the event of a subpoena, law enforcement request or Court Order requesting Message Muse Inc. distribute transaction information to a third party, Message Muse Inc. will make a reasonable attempt to notify the impacted client of any request for disclosure of client or transaction information prior to disclosure of information.

3. PCI Compliance

Message Muse Inc. uses only third party PCI-DSS compliant third party vendors to process card payment. Message Muse Inc. does not store, process or transfer any cardholder information. MessageMuse.com uses HTTPS and other security best practices. MessageMuse.com is not susceptible to card testing.

4. Limitation of liability

Liability under any Message Muse Inc. contract is limited to the amount paid by client under the contract unless specified differently in the contract between Message Muse Inc. and the client. Liability for disputed charges through Ecommerce are limited to the amount of the payment in dispute.

5. Disputes

Message Muse Inc. requests clients reach out to Message Muse Inc. immediately regarding any dispute of a charge to Message Muse Inc. Cardholders may also dispute payment through their card issuer.

Terms for other dispute resolution are specified in each Message Muse Inc. Contract for Services. In general the jurisdiction and venue for dispute resolution is the appropriate state or magistrate court in Richland County South Carolina. Unless otherwise specified, choice of law is the laws of the State of South Carolina.

6. Applicable law

By using the Message Muse website, you agree that the laws of the state of South Carolina, without regard to principles of conflict of laws, will govern interpretation of these Terms of Ecommerce and Credit Card Payment and any dispute of any sort that might arise between you and Message Muse Inc.

7. Modification and severability

We have the right to change or add to the terms of these Terms of Ecommerce and Credit Card Payment at any time, solely with prospective effect, and to change, delete, discontinue, or impose conditions on use of the Message Muse website by posting such changes on our website or any other website we maintain or own. You can access a copy of the current version of these Terms of Ecommerce and Credit Card Payment for Ecommerce and Credit Card Payment on our website at any time. You can find out when these Terms of Ecommerce and Credit Card Payment were last changed by checking the “Last updated” date at the top of the page.
